Child Custody: Child custody issues usually contain a vast array of factors that need to be considered. Often, clients tell us that they want “custody” of their children. However, in most instances parties do not understand that there are two types of custody arrangements that must be determined. Physical custody – the amount of time each parent is permitted to spend with the child; and legal custody – the parent who has the right to make decisions regarding the child’s health, education, and welfare. In some cases, a Court can order joint legal and physical custody of the minor children wherein both parents get to see their children equally and both parents get to share in the decision making regarding the minor children. The Court’s decision in child custody cases are dependent upon each particular set of circumstances which includes the child’s wishes, the role of the parent in the child’s life thus far, the circumstances of the parties going forward, and several other factors that the court considers to determine what is in the child’s best interest.
